Terms of Service

Welcome to VANSTU (“we,” “us,” or “our”), a collaboration app developed by VANSTU, accessible via mobile apps on iOS and Android, and our website (collectively, the “Services”). These Terms of Service (“Terms”) govern your access to and use of the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

 

 

1. Eligibility

 

You must be a registered VANSTU App (hereinafter referred to as the “App”) member, ambassador, or volunteer to use the Services. By using the Services, you represent and warrant that you are an authorized App user and have the legal capacity to enter into these Terms. If you are using the Services on behalf of VANSTU or another entity, you represent that you are authorized to bind that entity.

 

 

2. Account Registration

 

To access the Services, you must create an account (“Account”) using your VANSTU App credentials or other approved methods. You may register directly or via third-party social networking services (e.g., Facebook, Twitter, Google, or LinkedIn) (“SNS Accounts”). If using an SNS Account, we may access information from it as permitted by your privacy settings there. You agree to provide accurate, current, and complete information during registration and to update it as needed. You are responsible for maintaining the confidentiality of your Account credentials and for all activities under your Account.

 

 

3. Services Description

 

The VANSTU App is an open chat and collaboration platform for VANSTU members, ambassadors, and volunteers to participate in activities, collect points, and earn rewards.

 

For ambassadors and volunteers specifically, the App facilitates official team communication, enabling open collaboration with other members and admins. The App uses AI algorithms to analyze interactions (e.g., messages, response times, invitations) to measure, showcase, and certify involvement and soft skills such as communication, leadership, and collaboration.

 

For ambassadors and volunteers, every message and interaction contributes to your official profile, including certificates of involvement and quantified soft skills. For transparency, credibility, and to avoid abuse, all chats, messages, and interactions are publicly accessible. Results, such as rankings, percentiles, certifications, points, and rewards, may be publicly displayed.

 

 

4. User Conduct and Community Guidelines

 

You agree to use the Services responsibly and in compliance with applicable laws, VANSTU policies, and these Terms. Interactions should focus on collaborative, professional, and activity-related purposes. You must not:

 

  • Post or transmit content that is unlawful, harmful, abusive, defamatory, obscene, discriminatory, or promotes violence, hatred, or illegal activities;

  • Share private or sensitive information, as all content is publicly accessible;

  • Infringe on third-party rights, including intellectual property, privacy, or publicity rights;

  • Engage in spamming, unsolicited advertising, or unauthorized data collection;

  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services, servers, or networks;

  • Use automated tools (e.g., bots, scrapers) to access or extract data without our permission;

  • Impersonate others or provide false information;

  • Use the Services for non-VANSTU-related commercial purposes without our express consent;

  • Reverse engineer, decompile, or attempt to derive the source code of the Services or our AI algorithms.

 

We reserve the right to monitor, moderate, or remove content and to suspend or terminate Accounts for violations, at our sole discretion. You are solely responsible for your content and interactions. Do not share private or sensitive information, as all messages are publicly accessible.

 

 

5. Intellectual Property

 

The Services, including all content, features, AI models, and branding, are owned by VANSTU or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, revocable license to use the Services for VANSTU-related purposes, including participation in activities and collaboration.

 

You retain ownership of content you post but grant us a worldwide, royalty-free, perpetual license to use, analyze, display, and derive insights from it (e.g., for AI training, public certifications, profiles, points, and rewards), consistent with our Privacy Policy.

 

 

6. Disclaimers and Limitations of Liability

 

The Services are provided “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of AI-generated certifications, profiles, assessments, points, or rewards, which may contain biases or errors.

 

To the fullest extent permitted by law, we disclaim all liability for damages arising from your use of the Services, including indirect, incidental, or consequential damages. Our total liability shall not exceed $100.

 

We are not responsible for third-party content, links, or services integrated with the VANSTU App.

 

 

7. Indemnification

 

You agree to indemnify and hold VANSTU harmless from any claims, losses, or damages arising from your violation of these Terms, your content, or your use of the Services.

 

 

8. Termination

 

We may terminate or suspend your Account and access to the Services at any time, for any reason, including at VANSTU’s discretion. Upon termination, your license to use the Services ends, but sections that should survive termination (e.g., intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

 

 

9. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of laws principles. Any disputes shall be resolved through binding arbitration in British Columbia, except for matters eligible for small claims court or claims seeking injunctive relief.

 

 

10. Changes to Terms

 

We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance. We will notify you of material changes via the Services or email.

 

 

11. Miscellaneous

 

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and us regarding the Services.
